Hyperion äußert sich zur Auseinandersetzung mit Amiga Inc |

 Während es nicht die Politik von Hyperion Entertainment ist, laufende Rechtsstreitigkeiten zu kommentieren, würden wir gerne unseren Kunden (denen wir für die sehr zahlreichen Unterstützerbriefe danken möchten, die uns nach Bekanntwerden der Klage erreicht haben) versichern, dass die Entwicklung der AmigaOS 4.0-Komponenten weitergeht und auch während der gerichtlichen Auseinandersetzungen mit Amiga Inc. zügig fortschreitet.
Nach mehr als 18 Monaten unproduktiver Verhandlungen unseres Managements und unserer Anwälte mit Amiga Inc. begrüssen wir die Möglichkeit, unser Anliegen endlich vor Gericht darlegen zu können. Dies war leider die einzig verbliebene Möglichkeit, nachdem Amiga Inc. immer und immer wieder jegliche Versuche abgeblockt hat, die verbleibenden Streitfragen (einschließlich der "Party-Pack"- und "I am Amiga Club"-Coupon-Aktionen und der Unfähigkeit, die Rechte von Dritt-Entwicklern an deren geistigem Eigentum anzuerkennen) zu lösen.
Obwohl es Amiga Inc. nicht gelang, uns den Zugriff auf den Source-Code von AmigaOS 3.5 und 3.9 oder zumindest den überarbeiteten Source-Code von AmigaOS 3.1 zu ermöglichen, hat Hyperion Entertainment mit AmigaOS 4.0 ein Produkt abgeliefert, das alle vertraglichen Verpflichtungen und Entwicklungs-Ziele übertrifft (beispielsweise die komplette Entfernung aller Chipsatz-Abhängigkeiten), eine Tatsache die von Amiga Inc. sowohl öffentlich als auch vertraglich anerkannt wurde. Gemäß der Vereinbarung von 2001 mit Amiga Inc. stehen Hyperion sämtliche Einnahmen aus der Distribution von AmigaOS 4.0 zu, unabhängig davon ob die "Rückkauf-Klausel" aktiviert wurde oder nicht - diese Klausel bezieht sich ausschließlich auf Folgeversionen (AmigaOS 4.1 und darüberhinaus).
Wir werden uns deshalb energisch gegen die Klage zur Wehr setzen, die wir für völlig substanzlos halten, und wir sind sehr zuversichtlich das wir ein für uns positives Ergebnis erreichen werden.
Abschließend möchten wir Händler und andere Parteien daran erinnern, dass der Vertrieb von AmigaOS 4.0 ohne vorherige Genehmigung durch Hyperion VOF und bestimmte Drittentwickler nach EU-, US- und internationalem Urheberrecht illegal ist und demzufolge auf eigenes Risiko besagter Parteien erfolgt. |
